ON HAND & SALE ITEMS

For on hand and sale items, the delivery lead time is 10-14 business days from confirmation of payment.

PRE-ORDER ITEMS

⁠Production lead time is 10-12 weeks from confirmation of payment.

FINAL SALES

All sales are final. No cancellations, refunds, returns, material modifications, or exchanges are possible once payment for the order has been made.

TERMS OF PAYMENT

Full payment is required for all signed sales orders. For orders over TWO HUNDRED THOUSAND PESOS (Php 200,000.00), a minimum 50% down payment is required together with a post-dated check for the remaining 50%, dated 14 days before delivery date and payable to Philux, Inc. Prices are inclusive of VAT. Prices are subject to change without prior notice.

DELAYS

Philux is not liable for any delay/s beyond its control and/or due to any Force Majeure event, which includes but is not limited to, any event which could not be foreseen or which is foreseeable but inevitable, including any act of God or man such as fire, flood, typhoon, earthquake, outbreak, strike or other grave labor problem, riot, war, or a change in law, order, rule or regulation by the government.

FABRIC

For client-provided fabric, fabric swatch is required within 7 days from sales order date in order for the Philux team to ensure that fabric is suitable for selected furniture design. Once client-provided fabric is approved, full yardage of fabric is required within 7 days from approval. Philux is not liable for any issues that may arise from fabric quality.

PRODUCT

Client understands that although most furniture pieces are made of solid wood, certain pieces require use of wood veneers. Pieces are constructed with different wood species from varying origins and characteristics such as grain and density for structural purposes. Kiln-dried wood with commercially accepted moisture content is used. Solid wood may warp or crack if subjected to sudden fluctuations in temperature and humidity.

WOOD

Philux designs are constructed with solid wood and veneers, and composite mixed veneers. Client understands that wood is a natural material and minimal variations in color and texture are normal and acceptable. Wood furniture is susceptible to discoloration due to exposure to the elements, particularly direct sunlight and heat. Philux is not liable for any exposure to the elements due to improper placement of furniture post-delivery.

CARE

For wood furniture, clients should dust with a soft, dry cloth. Abrasives or household cleaners should not be applied to protect the finish. Blot spills immediately and wipe with a clean, damp cloth. Philux is not liable for damage incurred by improper care or maintenance.

PACKAGING

Furniture pieces are properly packed using PE foam. Delivery trucks are equipped to adequately protect the product/s during transport. Requests for special packaging (crating, corrugated carton), will incur an additional fee.

DELIVERY

Free delivery within Metro Manila (with the exception of ports, shipping lines, trucking and forwarder terminals) applies to all furniture (orders, off-the-floor, made-to-order) and does not apply to accessories and consignments. The delivery crew is not authorized to receive any form of payment. Sales Account Executive will confirm delivery schedule days from agreed target delivery. Delivery will not proceed without the client's written confirmation. Failed delivery despite client confirmation will incur a fee. Delivery outside Metro Manila will be through a third-party logistics provider and would have a corresponding fee. Philux is not liable for any damages caused by any third-party logistics or client-initiated transportation. All Philux pieces are shipped under ex-works terms (i.e. Philux is required to make goods available for the buyer at the warehouse at KM 16-17, East Service Road, Bicutan, Parañaque City, Metro Manila. Once the buyer collects the goods, the buyer assumes all responsibilities including transport to its destination.)

SAFETY PROTOCOL

Delivery crew members are provided face masks and shoe covers. Additional protective equipment or other safety protocol requirements will be on the account of the client.

FINAL INSPECTION

For pieces that are made-to-order, have special packaging, bound outside Metro Manila, and/or involve third-party logistics, client is required to conduct a final inspection of the order at the factory prior to packaging and scheduling of delivery. Clients can schedule final inspection with the Sales Account Executive within 7 business days from notification that order is ready. A waiver form must be signed in case the client or an authorized representative is unable to conduct a final inspection.

DELIVERY ACCESS

Client is responsible for evaluating the intended location of furniture and access to the area. Philux is not liable for any difficulty or failure to deliver the products. Delivery locations with corresponding permits or fees must be secured and settled by the client.

DELIVERY INSPECTION

Immediate removal of packaging and full inspection by client or representative upon delivery is required. Philux recommends that the person who placed the order handles inspection and receipt upon delivery. If not available, a representative duly authorized can receive the delivery. Signed delivery receipt by client or authorized representative shall be considered "received in good order and condition."

STORAGE FEE

Deliveries not accepted by the sales order date will incur a daily storage fee of sixty pesos (Php 60) per cubic meter (based on total volume of order), per day. If order remains undelivered after six (6) weeks, Philux has the right to cancel said order and forfeit any payments made.

RETURNS

Should there be an issue with the item/s, client can opt to reject delivery and note down the reason/s for rejection on the delivery receipt. Any return after delivery will be at the client’s expense, with pick-up and delivery charge of Php 1,000 to be applied. Philux is not responsible for transportation charges to/from anywhere outside Metro Manila.

WARRANTY

Philux furniture is covered by a one-year warranty for factory defects, otherwise, repairs will be on the client's account. The client is responsible for transportation of furniture to/from the factory. For consignment items, strictly no refunds, returns or exchanges and warranty.

SAFETY

For shelving, commodes, armoires, and other storage pieces, it is recommended that these be bolted to the walls or floors as an added precautionary measure. Philux is not liable for installation of any furniture.

CHILD PROOF

Philux is not responsible for child proofing of furniture pieces and is not liable for any untoward incidents.

OFF-THE-FLOOR

Off-the-floor pieces shall undergo additional quality assurance measures prior to delivery. Off-the-floor pieces, which are subject to a 10% discount, should be thoroughly inspected and shall be accepted as per its condition in the showroom. Requests for refurbishing or repair will incur additional fees.

CLIENT PICK-UP

Sales Account Executives are not permitted to carry furniture out of the showroom. Client pick-up is limited to small pieces and is subject to the rules and regulations of the mall or establishment. Larger pieces that require two or more people to carry should be picked up from the factory. Philux is not liable for any damages incurred during pullout / pick-up.

MATTRESS

Mattresses come in standard sizes of 39"x78" (Single), 54"x78" (Double), 60"x78" (Queen) and 72"x78" (King) and an approximately one inch allowance is allotted between mattress and bed frame. Philux is not liable for mattresses purchased elsewhere that do not fit based on our standard sizes.

FREE & HARMLESS CLAUSE

Philux Inc., its officers, agents and employees, are free and harmless from all liabilities and claims for damages to any property and/or for any injury or death, arising from the use of Philux furniture or any other product manufactured or sold by the latter. CONFIDENTIALITY

The Client acknowledges and accepts that Philux is the owner of all industrial and intellectual property rights, including but not limited to trademarks, designs, copyrights, and other industrial and intellectual property rights relating to the furniture pieces, including all moral rights and economic use on the same (together, the "Intellectual Property Rights").The Client acknowledges that any unauthorized use of the design and shop drawings constitutes a violation of the Intellectual Property Rights and as such punishable before the competent authorities.In particular, the receiver and, for it, its employees, collaborators and/or employees, agrees to and undertake not to carry out the following activities and not to allow third parties to:• design, manufacture, realization, offer for sale, distribute in any form, import and/or export products incorporating the design Philux or designs identical or similar to those incorporated in the furniture piece • making modifications, tampering, reworking or in any form in order to make and/or manufacture products similar and/or identical to the Philux design; • to make use, in any way, of the marks of Philux, or of trademarks identical or similar to, for products identical or similar to those for which Philux uses its distinctive trademarks, merely by affixing such signs to products, their packaging or components of the same, and/or through the use of such trademarks in commercial correspondence and advertising, including online;The Client, therefore, undertakes not to assert and not to grant or transfer to third parties any rights relating to the Intellectual Property Rights of Philux, unless specifically and expressly authorized by Philux.
